Municipal and Justice Court Appeals
The final judgment of Municipal and Justice Courts are appealed to the Mohave County Superior Court. The Superior Court Rules of Appellate Procedure (SCRAP) explain the procedure you must follow when appealing a decision from a Municipal or Justice Court to the Superior Court along with the Local Rules of Practice for the Superior Court in Mohave County.
WARNING: It is very important that you follow court procedures and meet the required deadlines. If you fail to do so, it is very likely that your appeal will be dismissed.
The Superior Court will not retry your case on appeal. The Superior Court only reviews the evidence and arguments that were presented to the court. The Superior Court will only reverse the Municipal or Justice Court decision if it finds an error of law that was so important that it likely affected the outcome of the case.
- Reverse the Trial Court (Municipal or Justice Court) and remand the case to the Trial Court for a new trial.
- Reverse the Trial Court (Municipal or Justice Court) and direct a verdict of acquittal, discharge the defendant, and exonerate any bond.
- Affirm the Trial Court (Municipal or Justice Court) and remand the case to the Trial Court for appropriate action.
- Affirm the judgment, but modify the sentence and remand the case to the Trial Court for action consistent with the modification.
