A person may file a Motion for Civil Standby with a justice court to allow the petitioner a safe environment to obtain personal belongings from a designated location. The court will review the motion and may grant an order for a civil standby.
A civil standby requires a designated law enforcement agency to accompany the petitioner to the designated location to retrieve their personal belongings. The civil standby is intended to provide a safe environment for the person picking up the property and/or the persons located at the property. This order will not address the ownership of personal property.
A civil standby will be completed at the convenience of the law enforcement agency and shall last no more than 20 minutes. A civil standby cannot be used as an order to pick-up or retrieve a minor child.
